These Terms and Conditions (the "Terms") apply to your use of this website and to quote requests, driver pre-applications, and other communications you send us through it. Motion United Transport ("Motion United," "we," "us") is a for-hire motor carrier based in Houston, Texas, operating under USDOT 7184944 and MC 99502659. By using this website you agree to these Terms.
1. Using this website
You may use this website to learn about our services, request freight quotes, apply to drive, and contact us. You agree not to:
- submit false, misleading, or someone else's information;
- interfere with the website's security or operation, or try to access systems you are not authorized to use;
- use the website for any unlawful purpose.
2. Quotes and rates
A quote is an estimate based on the information you give us, including lane, dates, equipment, commodity, weight, and handling requirements. A quote is not a binding offer. Rates become binding only when both parties sign a rate confirmation. We may revise a quote if the freight, schedule, or conditions differ from what was described, and quotes may expire if not accepted promptly.
3. Transportation services
Each shipment is governed by the signed rate confirmation, the bill of lading, and any written shipper or broker carrier agreement between you and us. If those documents conflict with these Terms, those documents control for that shipment. We may decline any load at our discretion, including loads that are unsafe, overweight, improperly described, or outside our authority or insurance.
4. Shipper responsibilities
- Accurately describe the freight, including commodity, weight, dimensions, value, and any special handling needs.
- Declare hazardous materials and comply with the Hazardous Materials Regulations (49 CFR Parts 171 to 180), including proper classification, packaging, marking, labeling, placards, and shipping papers.
- Load, block, and brace freight properly when you load it, and keep loads within legal weight limits.
- Provide an accurate bill of lading and accurate pickup and delivery information, including appointment requirements.
5. Accessorial charges
Charges beyond the line haul rate, such as detention, layover, truck ordered not used (TONU), stop offs, driver assist or lumper fees, tarping, and fuel surcharge, apply as stated on the rate confirmation. Unless the rate confirmation says otherwise, detention begins after two hours of free time at pickup or delivery. Lumper fees paid by the driver are billed back with a receipt.
6. Cargo loss and damage
Our liability for loss of or damage to cargo is governed by 49 U.S.C. 14706 and is limited to the lesser of the actual value of the goods, the amount stated on the rate confirmation, or the limit of our cargo insurance, unless a higher declared value is agreed to in writing before pickup. We are not liable for loss or damage caused by an act of God, the public enemy, an act or default of the shipper, the inherent nature of the goods, or an act of public authority.
Claims must be filed in writing within nine (9) months of delivery, or of the date delivery should have occurred, and must include supporting documentation such as the bill of lading, delivery receipt with exceptions noted, invoice, and proof of loss. Any exceptions should be noted on the delivery receipt at the time of delivery. We will not be liable for special, incidental, or consequential damages unless agreed to in writing.
7. Invoicing and payment
Unless otherwise agreed in writing, invoices are due 30 days from the invoice date. We may assign our receivables to a factoring company. If we do, you will receive a notice of assignment and must pay the factoring company as directed.
8. Driver pre-applications
Submitting a driver pre-application is not an offer of employment or of a lease agreement. Any hiring decision depends on a complete employment application and qualification under the Federal Motor Carrier Safety Regulations (49 CFR Part 391), including a motor vehicle record review, pre-employment drug testing under 49 CFR Part 382 and Part 40, an FMCSA Drug and Alcohol Clearinghouse query, and, with your authorization, a Pre-Employment Screening Program (PSP) report. Background reports are obtained only with your separate written disclosure and authorization as required by the Fair Credit Reporting Act. Motion United Transport is an equal opportunity employer.
9. Intellectual property
The Motion United name, wolf logo, and the content and design of this website belong to Motion United Transport or its licensors. You may not copy or reuse them without our written permission.
10. Disclaimers and limitation of liability
This website and its content are provided "as is." We work to keep information accurate, including equipment availability and specifications, but we do not guarantee it is complete or current. To the fullest extent permitted by law, we are not liable for any indirect or consequential damages arising from your use of this website. Nothing in this section limits our obligations under a signed rate confirmation or applicable federal law.
11. Governing law
These Terms are governed by the laws of the State of Texas and applicable federal law, without regard to conflict of law rules. Any dispute relating to these Terms will be brought in the state or federal courts located in Harris County, Texas, unless a signed agreement for a shipment provides otherwise.
12. Changes
We may update these Terms from time to time. The effective date at the top of this page shows when they last changed.
